18 U.S.C. §§ 2257 and 2257A Compliance Statement

1. Compliance Statement

KainsDomains supports compliance with all applicable federal age-verification, labeling and recordkeeping requirements, including 18 U.S.C. §§ 2257 and 2257A and the regulations contained in 28 C.F.R. Part 75.

The application of these requirements depends on the nature of the content, the date it was produced, the party responsible for producing it and the role of KainsDomains in displaying or distributing it.

For material for which KainsDomains or Kains Entertainment LLC is legally required to act as a producer and maintain records, the required age and identity records will be maintained by the applicable Custodian of Records at the location identified in this statement.

2. Third-Party, Licensed and Embedded Content

KainsDomains may display, embed, link to, index, organize or promote material supplied by independent studios, producers, distributors, content providers, advertisers, affiliate programs or other third parties.

For material KainsDomains did not produce and for which it is not legally the primary or secondary producer, the original producer or content provider is responsible for maintaining any records required under 18 U.S.C. §§ 2257 and 2257A.

Applicable recordkeeping information may appear within the content, on the original producer’s website, on the third-party destination page or in records maintained by that producer or provider.

3. Requirements for Content Providers

Any person, studio, advertiser, distributor or other provider that submits or supplies adult content for display through KainsDomains represents and warrants that:

• Every depicted performer was at least 18 years old when the material was produced;
• Every depicted performer had reached the legal age required to participate in the material;
• The identity and age of each performer were verified using legally sufficient documentation;
• All records required by 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 are properly created, indexed, maintained and available;
• All required disclosure statements and labels are properly displayed;
• Every depicted person knowingly and voluntarily consented to the creation and intended distribution of the material;
• The provider owns or possesses all rights, licenses, permissions and releases required to distribute the material;
• The content does not contain child sexual abuse material, unlawful sexual content or material depicting an actual minor; and
• The submission complies with applicable law and KainsDomains policies.

KainsDomains may request supporting information from a content provider when reasonably necessary to evaluate age, identity, consent, ownership or legal compliance.

Failure to provide requested information may result in rejection, restriction or removal of content and suspension or termination of associated access.

4. Custodian of Records

To the extent KainsDomains or Kains Entertainment LLC is required to maintain records for covered content, those records are maintained by the Custodian of Records identified below.

Records maintained by independent third-party producers are held by the applicable producer or custodian identified in that party’s own compliance statement.

5. Prohibited Content and Zero Tolerance

KainsDomains prohibits content that depicts or appears to depict a minor in a sexual context. We also prohibit content involving child sexual abuse, trafficking, coercion, actual sexual assault and other unlawful exploitation.

KainsDomains may remove or restrict reported content, preserve relevant records, terminate associated access and report information to appropriate service providers, reporting organizations or law-enforcement authorities when required or reasonably appropriate.

6. Consent and Content Removal

The 2257 recordkeeping process is separate from consent, privacy, copyright and performer-removal requests.

A person depicted in content, or an authorized representative, may submit a Content Removal Request when the concern involves consent, identity, privacy, personal safety or participation in the material.

A copyright owner or authorized representative should use the DMCA process when a complaint is based on copyright ownership.

7. Report an Age or Recordkeeping Concern

If you have a good-faith concern involving the apparent age of a performer, a required disclosure statement or age-verification records, notify KainsDomains promptly.

Include:

• The exact KainsDomains page or video URL;
• The title of the page or material;
• A brief, non-graphic explanation of the concern;
• The name of the producer or content provider, if known;
• Whether anyone appears to be in immediate danger; and
• A safe method of contacting you if additional information is required.
